Va. Code 20-97 requires that one party has been an actual bona fide resident and domiciliary of Virginia for at least six months before the suit is commenced. Domicile is not defeated merely by an overseas posting where the intent to return has been maintained, but it is a factual question, and the evidence — voting registration, tax filings, property, licences, where the family returns between assignments — matters more than the assignment history itself. Establishing it early avoids a jurisdictional fight later.
The Marital Share of Foreign Service Retirement
The portion of the benefit attributable to creditable service during the marriage is marital; service before and after is not. Where the parties were married across several tours, the service computation has to account for any periods of leave without pay, transferred credit, or deposits made for prior service. The division is ordinarily expressed as a fraction of the benefit computed at retirement rather than a present dollar amount.
Survivor Coverage and Implementation
As with other federal systems, a share of the annuity ends at the annuitant’s death unless survivor coverage is expressly provided. The election has a cost, a deadline, and consequences for the retiree’s monthly amount, and none of it follows automatically from an award of a share. Implementation requires an order in the form the administering agency accepts, which is why the order should be drafted alongside the agreement rather than after entry of the decree.

The productive window opens once appraisals and any forensic work have been exchanged, because only then can both sides see a realistic range, and it closes as trial preparation costs approach the amount genuinely in dispute. Trial remains right where a valuation gap cannot be bridged or where a party will not produce records. That decision deserves a written estimate of cost and realistic gain.
