The Order Is Directed to the System

An order dividing a federal benefit is directed to the administering agency rather than to the former spouse, and the agency will reject an order that does not conform to its own requirements even where a circuit court judge has entered it. Each system publishes what it will and will not accept. Drafting to the general language used for private plans is the most common and most expensive error in this area.

Survivor Benefits Are Separate

The right to a share of a retirement benefit and the right to continue receiving something after the participant dies are distinct rights requiring distinct provisions. An order that divides the annuity and says nothing about survivor coverage leaves the receiving spouse exposed to losing everything on the participant’s death. Elections may also be time-limited, which means this cannot be deferred to be sorted out later.

Classification Still Applies

Under Va. Code 20-107.3 the portion of a federal benefit attributable to service during the marriage is marital, and service before the marriage or after separation is treated differently. Establishing the service history and the correct marital fraction is a prerequisite to drafting anything, and the records supporting it come from the agency rather than from the participant’s recollection.
